Now as a young man I was told that birds of a feather stick together, I just did not understand what that meant until I got into the workplace some 30 years ago. What my mentors were teaching me was that is bankers know bankers and contractors know contractors. I cannot tell you with any amount of certainty that you are a byproduct of your environment, yet statistically it is more logical that while on the work site you come across many people doing various jobs other than yours, there may be:

It is time to make the website for Donnie’s ABC contracting service. This is where one of those – it was a great idea until it wasn’t stories. Let’s say for the argument that you are a electrician with two employees yet on your website…..
On your web-site
Now, here we go…. On your website is list the different types of work that you do as an electrician meaning everything within that field. Also a list a couple of things that you do not do but you could perform if need be – as an example you could do some industrial work when for the last seven years your work has been predominantly small repairs in the residential sector OH! But you could do it~!
Now, the goal here and what we are trying to obtain is an understanding of underwriting, what our goal “is not” – is try to judge someone’s expertise in their own field. So, let’s take look. Because you know Billy Bob and you also know “special Mike” – and they do concrete and painting at what would will hold this falls on your website.
Don’t do but could
It’s called sub-contracting: So, your website declares that you specialize in electrical contracting yet it also says that you can do concrete, welding, plumbing and all sorts of things that you stereo typically never do. The idea of course is that you can hire out this work: now you have entered into a situation where you are subcontracting. Have you ever heard the term – the experts make it look easy?. There are things that you want to consider and things that you may or may not know here are a few of each.
You are responsible
Now, the most common one line that I here as a licensed Texas insurance agent is this: “I don’t have any employees.” Yo may not have any employees, yet it’s just not that simple or cut and dry. When you (put the name of your company/you here) hire someone to do a job then you will most likely become responsible in case there is a claim along with the person you actually did the work. Now, nothing is perfect and no one knows the answer to everything – yet call your qualified licensed Texas insurance agent and ask them if you are responsible for a subcontractor you hired if there is a claim.
The answer it!
Now, there is no perfect answer here in there is no reliable scenario yet the higher odds are that if you hire Bob who does concrete and there is a Claim – Bob has been deemed negligent and an attorney is now involved – it certainly not impossible that you could be named in this U doing is feeling what he doing to me can be communicated to come here silly coming to be here lawsuit. Now no one here is giving legal advice but here’s something that will help you in the world of prudence. You want to be sure that the contractor that you hired to do a job has the following on there Dallas General Liability Insurance – Certificate.
- Insurance
- Named you as an additional insured
- You the certificate holder has a waiver of subrogation
- Call the company and confirm insurance is in place
- Keep on file for 10 years
The above is JUST a start there are other things that you may want to list on the certificate after you have verified that the certificate is good…… And here is a dirty little secret that can be true. There is a thing called a class code. In other words there is a different class code in insurance for electricians, plumbers, concrete workers… You get the idea. Be sure that your “subcontractor” is covered for the work they are going to produce on your by half……Yes we are still talking about your website, it just takes a while to get there.
Underwriter: What is this
Now, when you’re website declares that you do all of these different types of work (think class code) then the company that the underwriter works for is wanting to list these types of exposures on your policy. The short answer is each one of these are going to cost you a premium “yeah, that means money” – and there is little defense that the insurance agent has when they are looking at your website in Technicolor that is tethered to you and your company.
