The question is this
If all of my subcontractors are insured then why would it be prudent for a small general contractor to carry insurance? So, as an example if a person was doing a remodel job and had three contractors and all had insurance why would it be necessary for the person who hired the “insured subcontractors” to have coverage? Now, you’ll read this a lot in our blogs because there is a gray area here. Could it be possible that a subcontractor have a claim of say $30,000 in their insurance company pay that and walk away? It seems that most of the time the plumber, HVAC and electrician will carry insurance. We will address matching limits in another blog, yet today were going to talk about claims. What would happen if a claim were to arise by an insured subcontractor and the claim was paid and the insurance carrier turned around and litigated against you the person who hired subcontractor whom had the claim?

Now, there are precautions that you might want to take with your insured contractors that can quite possibly help in case of a claim when it comes to exposure. You may want to be a certificate holder on your subcontractors insurance and being named as an additional insured with a waiver of subrogation. Now, before we go into the explanation of what protection that may afford you let’s start with a different question. We started with what happens if the insurance company pays a claim and you receive a notice that you have been named in a lawsuit by the carrier that paid the claim.
What happens next
Now, here is the question that I don’t know that anyone could answer 100% accurately, would this happen if your HVAC or any insured subcontractor’s company pay the claim? For this blog all we can say is we just don’t know 100% yet that is not the question. The question remains the same who is going to pay the bill if you are named in a lawsuit because of a claim? Now, this is with the assumption you have no Dallas contractors insurance, Dallas general liability.
